Privacy Policy

This Privacy Policy explains how Kittix LLC collects, uses, shares, protects, and retains personal information in connection with our website, Microsoft Marketplace listing, Kittix software, licensing, sales, implementation, and support activities.

Kittix LLC (“Kittix,” “we,” “us,” or “our”) respects the privacy of customers, prospective customers, website visitors, business contacts, and users of Kittix products and services. This Privacy Policy describes the personal information we may process, why we process it, when we may share it, and the choices and rights that may be available to you.

1. Scope

This Privacy Policy applies to personal information Kittix processes in connection with:

  • the Kittix website and related web pages;
  • Kittix Core and other Kittix software;
  • Microsoft Marketplace and Partner Center leads relating to Kittix offers;
  • sales, licensing, subscriptions, orders, demonstrations, implementation, and consulting;
  • customer support and product suggestions; and
  • other business communications with Kittix.

This policy does not govern Microsoft products, services, or websites, or other third-party products and services. Those providers maintain their own privacy practices.

2. Information We May Collect

Depending on how you interact with Kittix, we may collect the following categories of information:

  • Contact and business information: name, job title, company, business email address, telephone number, and other business contact details.
  • Sales and subscription information: requested products, licensed sites or environments, order details, subscription status, billing-related information, and communications relating to a purchase or renewal.
  • Licensing information: information reasonably required to issue, validate, maintain, replace, or troubleshoot Kittix license entitlements, such as tenant, legal-entity, site, product, subscription, or entitlement information.
  • Support information: support requests, product questions, suggestions, D365 environment descriptions, error details, screenshots, logs, and other information you choose to provide when requesting assistance.
  • Website and technical information: IP address, browser or device information, request timestamps, referring information, and similar technical data that may be processed by our website hosting or security providers as part of operating and protecting the website.
  • Marketplace lead information: contact and company information that Microsoft makes available to Kittix when a prospective customer submits a lead or requests contact through Microsoft Marketplace.
  • Communications: emails, meeting information, correspondence, and records of interactions with Kittix.

Please do not send passwords, access tokens, private keys, payment-card data, or other credentials through support forms or ordinary email unless Kittix specifically provides a secure method and requests the information.

3. Kittix Core and Customer Data

Kittix Core is designed to operate primarily within the Customer’s Microsoft Dynamics 365 environment. Customer data remains owned or controlled by the Customer, and use of Kittix Core does not transfer ownership of Customer data to Kittix.

Kittix may receive or access Customer data when a Customer intentionally provides it to Kittix or authorizes access for implementation, licensing, troubleshooting, maintenance, support, or other requested services. We use that information only as reasonably necessary to provide the requested service, administer the customer relationship, comply with law, protect our systems and rights, or as otherwise described in an applicable agreement.

4. How We Use Information

Kittix may use personal information to:

  • respond to inquiries, demonstration requests, support requests, and product suggestions;
  • provide, operate, maintain, support, secure, and improve Kittix products and services;
  • prepare quotes, orders, subscriptions, invoices, renewals, and other commercial records;
  • issue, validate, replace, and administer Kittix licenses and entitlements;
  • communicate about product updates, service matters, security issues, account or subscription changes, and customer support;
  • understand prospective-customer and customer needs and improve our products, documentation, and business processes;
  • protect Kittix, our customers, our website, and our systems from fraud, abuse, security threats, or unlawful activity;
  • comply with legal, tax, accounting, regulatory, contractual, and recordkeeping obligations; and
  • establish, exercise, or defend legal rights.

5. Legal Bases for Processing

Where applicable law requires a legal basis for processing, Kittix may process personal information because it is necessary to perform or enter into a contract, because we have a legitimate business interest that is not overridden by your rights, because we must comply with a legal obligation, or because you have provided consent. Where processing is based on consent, you may withdraw that consent as permitted by applicable law.

6. How We Share Information

Kittix may disclose personal information only as reasonably necessary for legitimate business and legal purposes, including to:

  • service providers that help us host, secure, operate, communicate, support, or administer our business and website;
  • Microsoft or other technology providers when necessary to support the applicable Microsoft Dynamics 365, Marketplace, Azure, or related process;
  • professional advisers such as attorneys, accountants, insurers, and auditors;
  • government authorities or other parties when disclosure is required by law or reasonably necessary to protect legal rights, safety, or security; and
  • a successor or potential successor in connection with a merger, acquisition, financing, reorganization, or sale of all or part of Kittix, subject to appropriate confidentiality protections.

Kittix does not sell personal information for monetary consideration. Kittix does not use personal information for third-party targeted advertising or cross-context behavioral advertising.

7. Microsoft Marketplace

When you interact with a Kittix offer through Microsoft Marketplace, Microsoft may collect information under Microsoft’s own privacy terms and may provide Kittix with lead or contact information when you request contact or otherwise submit information in connection with our offer. Once Kittix receives that information, our processing of it is governed by this Privacy Policy.

8. Website Hosting and Cookies

The Kittix website is hosted using third-party infrastructure, including Microsoft Azure. Hosting, networking, and security providers may process technical information necessary to deliver website content, maintain reliability, prevent abuse, and protect the service.

Kittix does not use personal information collected through the website for third-party targeted advertising. If Kittix later introduces analytics, optional cookies, or similar technologies that require additional notice or consent, we will update our notices and practices as required by applicable law.

9. Data Retention

Kittix retains personal information only for as long as reasonably necessary for the purposes described in this Privacy Policy, including to provide products and services, maintain business and licensing records, comply with legal and tax obligations, resolve disputes, enforce agreements, and protect security and legal rights. Retention periods may vary depending on the type of information and the nature of the relationship.

10. Security

Kittix uses reasonable administrative, technical, and organizational safeguards designed to protect personal information against unauthorized access, loss, misuse, alteration, or disclosure. No transmission or storage system can be guaranteed to be completely secure, and Kittix cannot guarantee absolute security.

11. International Processing

Kittix is based in Texas, United States of America. Personal information may be processed in the United States or other countries where Kittix or its service providers operate. Where required, Kittix will use appropriate safeguards for international transfers of personal information.

12. Your Privacy Rights

Depending on where you reside and the law that applies, you may have rights regarding your personal information, including the right to request access, correction, deletion, portability, restriction, or objection to certain processing, and the right to withdraw consent where processing is based on consent.

You may also have the right to appeal a decision regarding a privacy request or to lodge a complaint with an applicable data-protection authority.

To submit a privacy request, contact Kittix using the information in Section 16. We may need to verify your identity or authority before completing a request. Kittix will not discriminate against you for exercising rights available under applicable law.

13. Children’s Privacy

Kittix products and services are intended for businesses and professional users and are not directed to children. Kittix does not knowingly seek to collect personal information from children through its products or website.

14. Third-Party Links and Services

Our website, documentation, or communications may contain links to Microsoft or other third-party websites and services. Kittix is not responsible for the privacy practices of third parties. We encourage you to review their privacy notices before providing personal information.

15. Changes to This Privacy Policy

Kittix may update this Privacy Policy as our products, services, legal requirements, or business practices change. When we make changes, we will update the effective date shown at the top of this page. Material changes will be communicated through appropriate means when required by law.
